before you comment. If you re-read my message on percentage rent, you find
that I explained how it works, and that the landlord does not receive a
percentage of all profits. In another of my messages I mentioned free rent
being a common incentive provided by landlords.

And you might want to re-read your #4131 post because one statement you made
didn't make sense -- "Obviously it stops when it's no longer benificial"!
Since when would it ever NOT be beneficial to the landlord?
I have no objections it a tenant & landlord want to do this - I personally
would not rent a mall space under those conditions nor if I owned one, would
I do that. Sorry - it's a matter of different opinions here. I am NOT saying
you are wrong at all - I just believe differently!
Just the other day I was talking to a video store owner that had just moved
to this location. I knew where she had came from and wondered why she moved,
giving up an attractive new small mall, seemingly in an excellant location.
She told me the owner wanted a percentage - plus the rent was nearly $2,000
per month and she could not make a good living there with her over head.
This other mall is older with a good location - the rent is $1,800 and the
stipulation was 'a 2 year lease'! She said the business was thriving. All
the spaces are rented in that mall and the landlord IS/has to be making a

year old). We have a 6 month old Peach Faced Parrot (cute little thing) and
it knows what is his!! You try to take out it's food dish or bells or bar

Let's try it from another angle Ann. Let's say a theoretical store
should rent for $2400 a month. But the landlord rents it for $1600 plus a
share of the gross over $20,000.
1st month rent = $1600 .... just getting started, little/no business.
2nd month rent = $1600 .... still setting up, sold $10,000 gross
3rd month rent = $1600 .... grossed $20,000..
4th month rent = $1800 .... grossed $30,000
5th month rent = $2000 .... grossed $40,000
6th month rent = $2200 .... grossed $50,000
7th month rent = $2400 .... 1st month landlord breaks even.
So for 6 months this new store got a break on it's rent...a break it
needed while getting it's feet off the ground. By the time that it's paying
more than the $2400, it should be in a profitable situation...if they know
how to run a business.
I know a computer store that was in a flat-rate center but once he moved
to a share of the gross center (better location) his sales tripled! There's
no way that he would move back to where he was. And your video store owner
will probably find herself back into a share of the gross rental once her 2
year lease expires....if the center is as good as you say and stays as full
as you say. Flat rate shopping centers are usually desperate...that's why
they go to flat rate rents...they need the renters. Once that changes, so
do they.

Good explaination LLoyd and I do not think this is bad at all. I was talking
about the landlords that take a profit right from the beginning and continue
to do so. Oops - I mean a percentage of the sales! No doubt, in a good mall,
$2,200 per month rent is not high. So in your case - the landlord gave the
tenant a good brake until he got on his feet and then finally got his 'fair'
rent. But I do not think the rent should go up from that nor should the

You're beginning to frustrate me.
Of course there's a situation where the landlord would be no longer
benefiting; a business could be messing the place up, or maintenance costs
could go very high, or the business could be so ill-kept that neighboring
tenants complained, and so on. You are simply doing what you accused Nick
of: failing to see the other side.
Explain to me how the first landlord hurt that video store owner. If what
he was offering was truly bad, he was only hurting himself -- because he was
driving away good tenants.
Also, could you explain to me why you're complaining? If you don't want the
government to do something, then what are you saying? If this is bad for
tenants, than the malls that do this won't get good tenants and will only
hurt themselves.
Doesn't it occur to you that since there are several people trying to
explain this to you, that maybe your opinion needs re-thinking?

I am not disagreeing with anyone here - I am just giving my side on what I
think is right and wrong. I do not think that landlords should take people's
money just because they rent from them. We have too many 'middlemen' in our
society with their hands in our pockets. Why should the landlord be
guaranteed anything - a buffer against the gamble he took when he
built/bought the mall?
I talked again with that video store lady yesterday and ask her more
details. Right from the beginning, the landlord gave no breaks and charged
$2,000 per month for a smallish space in a very small mall! She took the
gamble because the mall was located in a good spot and a convient store was
to be put in. He also wanted a percentage right off. (she did not say how
much!) The business flourished but because of the high rent and the
percentage rake off - she was not making what she knew she could. The
promiced convience store was never put in - the deal fell through she found
out later because he was taking too much of a cut out of the profits and
they wouldn't go for it. Two other businesses that moved in there had to
move also. By the way - her rent was to go up over a five year period to
$2,500. (Contractual!) She also complained of the extra paper work just to
satisfy him that he was getting his fair cut. He policed the place often. I
just don't think this is fair. (The rake off was to continue as long as she
was there too) Do you think this if fair - is good business? I don't.

Where she is now - the rent is under $2,000 per month - no percentage rake
off - she's making a good living and so is the landlord because everyone of
the stores are filled.
About three years ago we were seriously thinking of opening a Mr. Movie
franchise. I talked at length with the guy that owned one near us. This
store is in a 'super' mall (small) with a Lucky's store in it and every
space taken for years. I remember cringing at the rent of $3,200 per month
and ask how he could afford that. He said because the landlord does not take
a cut of the profits - even after the store got going good. There was a
ceiling on the rent of $3,800 also. The guy was just about to go into that
category but it didn't worry him. Because of this - only good quality stores
are in that mall - people that could afford it and chances are would not
fold. The landlord is fairly raking in the dough without any leeching of the
tenants. Because of his high rents - he made money from the beginning,
continues to do so - lured good tanants in there and they are making a great
living. I personally think the rents are too high - but it beats the heck
out of leeching! It culls out the tenants that probably wouldn't make it to
begin with. I don't 100% disagree with what your saying - it no doubt works
for some. But there are other ways. =*--ANN--*=

The landlord *must* be making some money based upon the store's income, or
why else would the video store owner be about to 'change categories' to a
higher monthly rent?
Sounds to me like this is similar to some of the other plans that have been
explained over the last week, not one of the 'other ways'.

considered to be our finest United States Senator ever.

My refereence to Barry Goldwater as an insufferable ass was an expresion of
my opinion, to which I am as entitled as you are to yours.
Mine was based on some brief personal acquaintenance, and as far as I am
concerned, valid.
The fact that he was and is an insufferable ass does not subtract one iota
from the fact that he was a very influential and powerful senator when he
was in office.
That he was the "greatest senator ever" is certainly open to question.
